PCC General terms and conditions

  1. Terms
    We are pleased to ship COD or on major credit cards.Other terms subject to prior credit approval. Prices, terms, availability, and specs are subject to change without notice.
  2. Shipping
    All sales are FOB PCC's warehouse (except containers landed port of entry) unless otherwise noted. Goods shipped at buyer's risk regardless of packing. Since our responsibility ceases upon delivery in good order to carrier, we recommend that you insure all shipments. All shortage or damage must be reported to carrier at time of delivery. Actual packing/handling charges will be added to UPS and less than pallet shipments.
  3. Orders
    Always call for updated samples, stock and pricing information. Sample may differ from actual shipment. Verify that the shipment is correct and that you order enough materials before installation. Buyer assumes responsibility for correctness of order. Because of the nature of the supplies, we cannot be liable for any discontinuation, delay or failure in the delivery or shipment of goods or for any damages suffered by reason thereof. All sizes are nominal, approximate. Tile sold in full cartons. $5.00 charge applies on fractional carton orders. Order cancellations subject to 20% cancellation charge. 50% non-refundable deposit on all special order items.No returns on special orders. Orders held over 30 days are subject to cancellation. Returns require written authorization and receipt. No returns or refunds after 15 days from purchase. Returns are to be prepaid. Restocking charge 20%. Only saleable merchandise in good condition, in full boxes and original undamaged packaging may be considered for return. Returns against volume priced purchases are subject to price adjustment.
  4. Limited Warranty
    All sales are as is and final unless otherwise indicated in invoice. No warranty for crazing, shading, scratching, sizing, wear, surface finish, cleanability, slipperiness, chemical, thermal or mechanical attack or damage or defects discovered after installation. Shading, sizing and other variations are characteristics inherent in ceramic tile. Shade or availability of a given tile or trim cannot be guaranteed. Grouts may shade or discolor. Installation constitutes acceptance. Layout all tile and check carefully for shade, size, color, finish, etc. before installation. No claims after installation. CAUTION: Ceramic tiles may break with sharp cutting edges. Tiles may be slippery. PCC accepts no responsibility for any slipping mishap or injury. Star(s) denotes non-premium grades. PCCs responsibility and buyers exclusive remedy is not to exceed refund of purchase price or replacement of material FOB origin at PCCs option. Not responsible for labor under any circumstances. This is in lieu of any other express or implied warranty including that of merchantability or fitness for any specific purpose or application. Vendor disclaims any liability for consequential or incidental damages. NOTICE: Any other warranty or liability, statutory, express or implied, are excluded, null and void. Buyer agrees to indemnify and hold vendor harmless if Buyer fails to notify subsequent buyers, installers and/or users of limitations resulting from these Terms and Limited Warranty.
  5. Codes
    Since code requirements vary greatly from area to area, Buyer should determine whether there are any specific code restrictions on the use of a specific product. Vendor makes no representation or warranty regarding, and shall not be responsible for any code compliance.
  6. Collections
    $29.00 minimum charge per returned check and per late payment per month. Payments overdue shall be subject to a 1.5% interest per month (18% per annum)or, if limited in a given state, to the highest allowable in that state. Buyer agrees to pay all attorneys fees and collection costs and agrees that if suit is brought, venue shall be in Lee County. Buyer agrees that vendor shall retain title and shall have first lien rights on all material delivered that remains unpaid. Buyer authorizes PCC to record the debt with the State if needed and grants the right for PCC to repossess unpaid goods without court or police order. Vendor retains title of goods until fully paid.
